Has anyone heard about this sorry affair? Racing is dangerous and bad things happen, it's tough s*** if you don't want to get hurt take up knitting grrr rant over!

Worth while reading for anyone doing club racing/thinking about it.
If that goes through it's going to be a nightmare, send them our support, that sucks big style! If they do get anything started to help their case we can help with (ie a petition etc) let us know

+1 on what Tweek said, but also consider Track days as well!!
If this starts with club racing, it will eventually get into track days as well!!!

Thats ridiculous! surely it won't go forward?
I think the main point on this one is that the practise day was pointed out as not having the same insurance cover as the race days... could be wrong though....

As far as I am concerned if you sign the disclaimer that should be it, and to suggest someone deliberately hit you at 120mph is stupid, and to try and sue the guy that owns the bike is even worse!!!
Really really hope it just gets laughed out of court
Interesting thread, I don't see the precedent though, as one of the respondents has already stated the same laws apply on the on the track as off it, the claiment has to prove beyond reasonable doubt that somebody was negligent for his claim to succeed, ( easier to do in a civil matter than a criminal case), none of us were present so we cannot really comment on who is to blame, my own opionion is that there are inherent risks in riding a bike on a track, we all know this even when we just do track days, in our own minds we weigh up those risks against reward and make our choices, there could well occasions when I would consider it legitimate to sue or to reqest the instigaton of criminal proceedings if for example a rider elected to take to the track on a machine he knowingly knew to be dangerous ie defective brakes etc, we all know how we'd feel if we were taken out by somebody who's bike could'nt stop due to poor maintenance, there has to be a balance on the track though, from what I've read it just seems like the rough and tumble of a racetrack, if the other rider could prove intent or malice then this could quite easily become a criminal matter, we are seeing more and more of this sort if litigation in amateur sports such as rugby where people are being sued for collapsing scrums etc.
both shocked and amazed at this, surely this cant hold any water its rediculous, i would have thought the disclaimer signed would be enough to get it thrown out, nobody crashes on purpose, its just a race incident..
I can't see it sticking. Just some amblance chasing lawyer keeping the case going so he can screw as much legal aid out the system as possible.
How in Gods name could they prove intent or negilgence?

WTF is this world coming to? we all know the risks when we enter a track or race so why when it goes wrong do we think we have the right to sue :shrug:
